Eligibility Criteria

Age Requirement:
To participate in the “12 Days of Giveaways” Holiday Contest, entrants must be at least 19 years of age at the time of entry. This age requirement is in place to ensure full compliance with Ontario’s legal standards. Proof of age may be required to claim a prize.

Email Account Restrictions:
To ensure authenticity and fairness in the contest, entries submitted from free email service accounts, such as Hotmail, Gmail, Yahoo, and others, are not eligible to win. Entrants must use a valid, non-free email account for entry. This measure discourages multiple entries and potential fraud, maintaining the contest’s integrity.

Residency:
This contest is open to legal residents of Canada. Entrants must be residing in the country at the time of entry and when claiming any prize.

Additional Restrictions:
Employees of Velocity Solutions, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the Contest.

By entering the contest, participants agree to abide by these eligibility requirements and warrant that they meet all such criteria. Any entry that does not comply with these requirements will be disqualified.

Contest Period

The “12 Days of Giveaways” Holiday Contest will commence on December 1st, 2023, at 12:00 AM Eastern Standard Time (EST) and conclude on December 22nd, 2023, at 12:00 PM EST (the “Contest Period”). Entries submitted before or after the Contest Period will not be eligible.

During this time frame, participants can enter the contest and be eligible to win one of the 12 prizes. Each day represents a new chance to win, featuring a different daily prize. Participants are encouraged to visit our official contest page regularly for updates and to participate in the daily giveaways.

Please note that the contest’s start and end times are based on Eastern Standard Time. Participants are responsible for converting these times to their local time zones to ensure timely participation.

Entries must be received within the specified Contest Period to be considered valid. Velocity Solutions reserves the right to extend, shorten, modify, or cancel the contest at any time, should unforeseen circumstances arise, in compliance with applicable laws and with proper notice to participants.

How to Enter

No Purchase Necessary:
Participation in the “12 Days of Giveaways” Holiday Contest does not require a purchase or payment. Making a purchase will not increase your chances of winning.

Entry Period:
Participants can enter the contest from noon Eastern Standard Time (EST) until 11:59 AM EST the following day. This daily entry period allows participants to enter for each day’s giveaway.

Method of Entry:
To enter the contest, participants must visit the daily blog post associated with the “12 Days of Giveaways” on Velocity Solutions website. A new blog post will be published each day, corresponding to that day’s giveaway. Participants must follow the instructions provided in the blog post to submit their entries.

Earning Extra Entries:
Participants can earn additional entries to increase their chances of winning. Additional entries can be earned in the following ways:

  1. Referring Another Business: If a participant refers another business to the contest and that business enters the contest, the referring participant will receive an extra entry.
  2. Following Our Social Channels: Participants can earn extra entries by following Velocity Solutions’ social media channels. The daily blog post will provide details and links to the social media channels.
  3. Joining the Mailing List: Signing up for Velocity Solutions mailing list will also grant participants an additional entry.
  4. Entering Daily: Entries are carried forward, but you can earn extra entries by re-entering for each daily prize.

Entries Carried Forward:
Once a participant enters the contest, their entry is automatically carried forward for subsequent draws. This means that participants enter the draw for any remaining contest days by entering once. However, participants are encouraged to re-enter daily to earn extra chances to win, as outlined above.

Prize Conditions:

  • Prizes are non-transferable and cannot be exchanged for cash.
  • The retail value of each prize is as stated above and reflects the market price as of the date these Terms and Conditions were drafted.
  • If a prize is unavailable, Velocity Solutions reserves the right to substitute it with a prize of equal or greater value.
  • Prize winners are solely responsible for any additional costs associated with prize redemption, such as taxes or additional expenses.

Winner Notification:

  • Prize winners will be notified via the contact information provided at entry.
  • Winners must respond within 30 days to claim their prize, as detailed in the Winner Selection and Notification section of these Terms and Conditions.
  • Failure to claim the prize within this period, or inability to comply with any term or condition of these Terms and Conditions, may result in disqualification and the selection of an alternate winner.

Publicity:

  • Acceptance of a prize constitutes permission for Velocity Solutions to use the winner’s name, likeness, and entry for advertising and trade without further compensation unless prohibited by law.

By entering this contest, participants agree to be bound by these terms and to comply with all federal and provincial laws and regulations. Non-compliance with these terms may result in disqualification.

Winner Selection and Notification

Selection of Winners:

  • Each day’s prize winners in the “12 Days of Giveaways” Holiday Contest will be selected through a random draw. The draw will be conducted from all eligible entries for that specific day’s prize.
  • The daily draws will occur at 12:00 PM (noon) Eastern Standard Time (EST) the following day.

Notification of Winners:

  • Winners will be notified via their business email address provided at the time of entry.
  • The participants must provide a valid and correct email address and check their email, including spam/junk folders, for notification.

Claiming the Prize:

  • Winners have 30 days from the date of notification to claim their prize.
  • To claim a prize, winners must follow the instructions in the notification email. This may include providing additional information or completing specific verification steps.
  • Failure to claim the prize within these 30 days will result in forfeiture of the prize. Velocity Solutions reserves the right to select an alternate winner or dispose of the prize in a manner consistent with the contest rules and applicable laws.

Delivery of Prizes:

  • Physical prizes will be delivered to the winners’ business addresses within Canada. Velocity Solutions will cover delivery costs.
  • The winners are responsible for providing an accurate and complete business address for prize delivery.
  • Electronic prizes, such as gift cards, will be emailed to the winners.

Liability for Delivery:

  • Velocity Solutions is not responsible for lost, stolen, delayed, damaged, or misdirected prizes after dispatch.
  • In any dispute regarding the delivery or receipt of any prize, Velocity Solutions will reasonably address such concerns but is not obliged to provide a replacement prize.

By participating in the “12 Days of Giveaways” Holiday Contest, entrants agree to be bound by these Winner Selection and Notification terms and acknowledge that Velocity Solutions’ decision is final and binding in all matters related to the contest.

Release and Limitations of Liability

Release of Liability:
By participating in the “12 Days of Giveaways” Holiday Contest, entrants agree to release and hold harmless Velocity Solutions, their respective parent, subsidiary, and affiliated companies, the suppliers and distributors of any contest materials, and each of their respective officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the contest or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the contest or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the contest, and in no event shall the entrant be entitled to attorneys’ fees.

Disclaimer of Warranties:
The Released Parties make no warranties and hereby disclaim any and all warranties, express or implied, concerning any prize furnished in connection with the contest. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, AND THE RELEASED PARTIES HEREBY DISCLAIM ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

Limitation of Liability:
Notwithstanding the release provided above, in no event will the Released Parties be liable for any special, consequential, indirect, incidental, punitive, reliance, or exemplary damages, whether in tort, contract, or any other legal theory, arising out of or in any way connected with this agreement or your use of or attempt to use any of the rights granted hereunder, including, but not limited to, damages for lost profits, goodwill, use, or data. This limitation on liability shall not preclude recovery of direct damages for claims that are actionable under the standard limited warranty provided herein.

Acknowledgment:
By entering the contest, all entrants acknowledge their understanding and acceptance of this Release and Limitations of Liability clause and agree not to bring any kind of legal action against the Released Parties as a result of any losses, damages, rights, claims, and actions of any kind in connection with the contest or resulting from the acceptance, possession, or use of any prize, including without limitation, personal injuries, death, and property damage.

Personal Information and Data Usage

Compliance with Privacy Laws:
Velocity Solutions is committed to upholding the highest standards of data privacy and protection. All personal data collected in connection with the “12 Days of Giveaways” Holiday Contest will be stored and managed in compliance with local Ontario and Canadian laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and other relevant privacy regulations.

General Conditions

Compliance with Laws:
The “12 Days of Giveaways” Holiday Contest is subject to all applicable federal, provincial, and local laws and regulations governing contests in Ontario, Canada. By entering the contest, participants agree to abide by these laws and regulations and the terms and conditions set forth herein. Void where prohibited or restricted by law.

Contest Administration:
Velocity Solutions reserve the right to cancel, suspend, or modify the contest if any problem prevents the contest from being conducted as planned. This includes, but is not limited to, fraud, technical failures, or any other factors beyond reasonable control which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the contest. In such cases, Velocity Solutions may, at its discretion, select the winners from all eligible entries received prior to the action taken.

Decisions Final:
All decisions of Velocity Solutions and/or Velocity Solutions regarding the contest and the application of these Terms and Conditions are final and binding.

Disqualification:
Velocity Solutions reserves the right to disqualify any participant or winner who, in Velocity Solutions reasonable suspicion, tampers with the entry process, violates these terms and conditions, or acts in an unsportsmanlike or disruptive manner.

Publicity:
Except where prohibited by law, participation in the contest constitutes winner’s consent to Velocity Solutions and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and province for promotional purposes in any media, worldwide, without further payment or consideration.

Indemnification:
By entering, participants agree to indemnify, defend, and hold harmless Velocity Solutions and their respective officers, directors, employees, and agents from any and all liability, loss, damage, expense, or cost of any nature whatsoever for any claims, demands, or proceedings arising out of participation in the contest or any contest-related activity, or compliance or non-compliance with these Terms and Conditions.

Changes to Terms and Conditions:
Velocity Solutions reserves the right to amend these Terms and Conditions at any time without prior notice. Amendments will be effective immediately upon being posted on Velocity Solutions website. It is the responsibility of participants to ensure awareness of any such amendments.

Conduct on Social Media:

Dispute Resolution

Governing Law:
The “12 Days of Giveaways” Holiday Contest and these Terms and Conditions will be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. By participating in the contest, entrants agree to be bound by the laws of these jurisdictions.

Resolution of Disputes:

  • In the event of a dispute arising out of or in connection with the contest, including but not limited to disputes concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, the parties shall first seek to resolve the dispute through informal negotiation.
  • If the dispute cannot be resolved through informal negotiation within a reasonable time period, the parties agree to submit the dispute to binding arbitration. The arbitration shall be conducted in Ontario, in accordance with the Arbitration Act, 1991 (Ontario), or any successor legislation.
  • The decision of the arbitrator will be final and binding on the parties, and no party shall have the right to appeal such decision to any court or tribunal.

Limitation on Claims:

  • Any claim or dispute arising out of or relating to the contest or these Terms and Conditions must be filed within one (1) year after such claim or cause of action arose. Otherwise, such claim or cause of action shall be permanently barred, notwithstanding any statute or law to the contrary.

Waiver of Class Actions:

  • To the extent permitted by applicable law, by participating in the contest, entrants waive the right to pursue any claim, dispute, or action against Velocity Solutions or its affiliates in a class action, consolidated action, or in any other proceeding in which either party acts or proposes to act in a representative capacity.

No Waiver of Statutory Rights:

  • Nothing in these Terms and Conditions shall be deemed to exclude or limit any statutory rights which a participant may have as a consumer under applicable local law.
